Chiller King Terms & Conditions
AGREEMENT TO HIRE RENTAL TRAILER
By confirming your booking or signing the rental agreement, you (the Hirer) irrevocably agree to the following terms and conditions:
Trailer Description
Chiller King (referred to as the Owner) will let, and the Hirer will take on hire, the rental trailer described in the booking confirmation, referred to hereafter as the "trailer."
Duration of Hire
The term of hire shall be as specified in the booking confirmation or agreed upon with the Owner.
Persons Who May Tow the Trailer
- The trailer may only be towed during the hire period by persons named in the rental agreement who hold a current and valid driver’s licence appropriate for towing the trailer.
- If the trailer is towed by an unnamed driver and damage occurs, the Hirer becomes fully liable for all costs, including salvage, repair, and third-party damages, which shall be immediately payable.
Payments by the Hirer
- The Hirer shall pay the Owner the agreed rental amount for the specified hire period.
- Overdue Charges: Late returns will incur a charge of $10 per hour beyond the agreed return time.
- Incident Fees: If the trailer is involved in an incident, the Hirer agrees to pay rental fees at the trailer’s daily rate until it is returned to Chiller King after repairs.
- Insurance Fees: The Hirer agrees to pay any insurance fees outlined in the agreement.
-
Infringements:
- If a road toll, parking, or traffic infringement occurs during the hire period, a processing fee of $45 per infringement will apply, in addition to the infringement or toll fee. These charges will be processed against the Hirer’s nominated credit card.
- The Owner may transfer the infringement notice to the Hirer, who will then deal directly with the relevant authority.
- The Hirer agrees to pay all charges on demand for any breach of the rental agreement, including damage or loss to the trailer or third-party property.
Hirer’s Obligations
- The trailer must not be used:
- For any illegal purposes.
- On unsuitable or unsealed roads unless expressly permitted.
- The trailer must be returned in the same clean condition it was provided. A cleaning fee may apply for returns in an unsatisfactory state.
- The Hirer is responsible for securing and ensuring the trailer is safely parked or stored when not in use.
Owner’s Obligations
- The Owner will provide the trailer in clean, roadworthy, and operational condition.
- The Owner is not responsible for:
- Loss or damage to any goods stored in the trailer during the hire period.
- Any delays caused by circumstances beyond the Owner’s control.
Insurance and Liability
- The Hirer acknowledges that standard insurance applies as outlined in the agreement. Excess charges may apply in the event of damage.
- Insurance does not cover:
- Damage caused by negligence or misuse.
- Loss or theft of the trailer due to improper security.
- Damage caused by towing with an unsuitable vehicle.
- The Hirer is liable for all costs arising from:
- Damage caused by an unauthorised driver.
- Breach of any terms outlined in this agreement.
Trailer Use and Maintenance
- The Hirer is responsible for:
- Ensuring the trailer is used for its intended purpose (e.g., mobile refrigeration).
- Properly connecting the trailer to a standard household power point for operation.
- Any mechanical or operational issues must be reported to Chiller King immediately. The Hirer must not attempt to repair the trailer themselves.
Returns and Cancellations
-
Standard Return Policy:
- Trailers must be returned by the agreed-upon time and location. Late returns will incur additional charges.
-
Cancellation Fees:
- Cancellations within 48 hours of the hire period may incur a cancellation fee.
